This case is before us on plaintiff's appeal from a judgment dismissing his suit asserting claims for damages arising out of an automobile accident which occurred at approximately 9 o'clock on the evening of November 22, 1956, on Highway U. S. 80 in the State of Alabama, about one mile east of the City of Demopolis. Plaintiff's minor son, Woodrow Clifton Smith, then 17 years of age, was riding as a nonpaying...
