Plaintiff instituted this suit seeking recovery of the sum of $350 representing the value of his vehicle which was a total loss as the result of an accident that occurred on or about March 23, 1958 at about 5:40 p.m. on U.S. Highway 51 near Hammond, Louisiana. The vehicle with which he collided was driven by defendant C. L. Blakewell, Jr. (Blackwell).

In the petition plaintiff filed, the allegation was made that the automobile operated by Blakewell...
