This is an appeal from a judgment of the Daviess Circuit Court confirming the appointment of a guardian for an infant by the county court.

Both appellant and appellee, the uncle and aunt of an adopted infant, applied for appointment as guardian in the county court on the same day, following the death of the child's adoptive mother.
