This is an eminent domain suit, brought by appellant, Mississippi State Highway Commission, in the County Court of the First Judicial District of Jones County, against appellees, Mrs. Taylor, her husband, and beneficiary and trustee in the deed of trust. The jury awarded damages for the taking in the amount of $40,000. The County Court's judgment based on that verdict was affirmed by the Circuit Court.
