On November 23, 1951, about 7:00 p. m., Richard Neil Bell, the husband of appellant, lost his life as the result of a collision between a car which he was driving and a 5-ton truck owned by The Kroger Company and being driven at the time by Windfrey Sory.

Suit was brought by the deceased's widow to recover damages based on the following allegations of negligence:
