This is an action of tort under the Federal employers' liability act (hereinafter called the act), 45 U.S.C. (1952) § 51 et seq. The plaintiff's substitute bill of exceptions presents the question whether the trial judge correctly directed a verdict for the defendant, and also raises questions with respect to the exclusion of certain evidence.
