George Funches, hereinafter called defendant, was indicted in Cook County for the crime against nature upon another male person, which crime occurred June 24, 1958. On July 9, 1958, he was arraigned and advised of his rights, and asked that counsel be appointed, which was done, and he then pleaded not guilty.
