This is an action by the United States for the recovery of penalties claimed to be due on account of the defendant's violations of restrictions imposed upon him with respect to the 1956 upland cotton crop year under the Agricultural Adjustment Act of 1938,1 as amended. After the denial of the plaintiff's motion for summary judgment and an abortive trial, following which a jury was unable to reach an agreement...
