The appeal is from a judgment of conviction for rape, with infliction of the death penalty. Appellant is of the Negro race. The victim is a white woman. The alleged crime was committed on Saturday, November 1, 1958. Appellant was indicted on November 6, 1958, and was arraigned on November 21, 1958.
