Appellee Temple Lumber Company, now merged into Southern Pine Lumber Company, as plaintiff in the trial court, filed suit in trespass to try title against appellant W. E. Smith, as defendant, for 120 acres of land of the R. Burroughs 160 acre survey in Sabine and Newton Counties.
