The plaintiff, Mabel Whitner, originally filed this tort action for damages against Aaron Scott and Earl Lee Miller and Miller's liability insurance carrier, New Amsterdam Casualty Company. Plaintiff was injured while riding as a guest passenger in the automobile being driven by Aaron Scott and which was involved in a collision with an automobile owned and being driven by the defendant Earl Lee Miller....
