This is the plaintiff's appeal from the dismissal by the Appellate Division of a report in a case tried in the District Court of Southern Essex in which the finding was for the defendant. The declaration averred breach by Helen K. Ross of a contract to convey land in Swampscott. The defendant is the administrator of the estate of Ross.
