On November 20, 1956, Joe Brown Dollar filed in Grady Superior Court his application for partition of certain lands in said county as therein described. The petition recited that the plaintiff and defendant, L. W. Dollar, "are the common owners in fee simple" of said lands; that the interest of the plaintiff and the defendant respectively in said lands "is as follows: Joe Brown Dollar a six-sevenths interest; L. W. Dollar a one-seventh interest....
