Plaintiff's petition alleged personal injuries resulting from a fall on the sidewalk. Trial to a jury resulted in a verdict in favor of the plaintiff in the amount of $5,000. Defendant filed motion for new trial which was sustained because of error in plaintiff's damage instruction, which authorized a recovery for permanent injuries.
