HEAD, Justice.

1. Code § 74-9901 provides that if the father of a bastard child shall refuse or fail to give security for the maintenance and education of such child and certain expenses of the mother, when required to do so in terms of law, he shall be guilty of a misdemeanor. In the present case the record discloses that the defendant failed and refused to give security in the bastardy proceeding, and he was convicted under § 74-9901.
