This is an action for a declaratory judgment instituted by the plaintiff, Pan American Petroleum Corporation, against the defendant, Cities Service Gas Company. The suit was originally filed in the District Court of Seward County, Kansas, for the purpose of securing a declaratory judgment under Kan.G.S. 1949, 60-3127 to 60-3132c, inclusive. On June 25, 1958, the defendant removed the suit to this court under the authority of 28 U.S.C. § 1441...
