This is an action of tort brought against the defendant Lach and three of his employees, Frazer, Melanson and Nihiley, to recover for the death and conscious suffering of the plaintiff's intestate, a boy aged six years, resulting from a collision with a truck owned by Lach and operated by Frazer on June 9, 1954. The plaintiff waived the counts against Melanson and Nihiley and the judge denied the motions of Lach and Frazer for directed verdicts for them...
