The defendant, Vassallo, demurs to an indictment charging him and four others with two crimes in two separate counts.

The indictment reads as follows:

"FIRST COUNT. "THE GRAND JURY OF THE COUNTY OF KINGS, by this count in this indictment, accuse the defendants, each aiding and abetting the other, of the crime of OBSCENE PRINTS AND ARTICLES, CONTRARY TO PENAL LAW...
