CURRIE, J.

We are confronted on this appeal with what disposition should be made of the estate of the testatrix in view of the fact that she was murdered by her husband who was bequeathed her entire estate.

James Barr Ames in his Lectures on Legal History, page 311, points out that there are three possible answers which the courts have given to this type of problem where the only contending parties are the murderer...
