Counsel for the defendants contend that where a principal and his agent are sued as joint tortfeasors in the county of the residence of the agent and it develops that the agent is not a joint tortfeasor, and that the principal is not a resident in the county in which suit is brought, the suit can not be maintained in that jurisdiction.
