This is an appeal from the granting of defendant's, appellee's, motion for a judgment N.O.V. in a personal injury case after the jury had awarded damages to the plaintiff, appellant. On June 13, 1953, the appellant, Festus Fowler, in the junking business, was returning to the junk yard driving a horse and wagon west on Bloom Street in Baltimore City.
