Defendant was accused by indictment in two counts with violating section 653f of the Penal Code in that he "solicit[ed]" Casper Berger (Count I) and Albert Levin (Count III) "to offer and accept and join in the offer and acceptance of a bribe." He was also accused in two counts of grand theft. In a jury trial he was found guilty of the offenses charged in Counts I and III and not guilty of grand theft (Counts II and IV).
