The infant plaintiff, Nicholas Donadio, by his guardian ad litem, Albert Donadio, brought an action to recover for injuries alleged to have been sustained as the result of defendant's negligence in permitting a dangerous and unsafe tree to remain along a city street. The father's derivative action for medical and hospital expenses and loss of services was tried together with that of the infant.
