MATTHEWS, District Judge.

By this action the plaintiff seeks to have the court compel the defendants to promote him to the rank of Lieutenant in the United States Park Police. He maintains that the Promotion Policy of the United States Park Police requires that a vacancy be filled by promotion of the highest numerically rated applicant. He says he is entitled to the promotion to Lieutenant as he attained the highest score on the examination conducted in February 1955...
