The defendant was charged in bill of information with "the crime of gambling as defined in LSA-R.S. 14:90 in that he did unlawfully and intentionally conduct and directly assist in conducting, as a business, at Treme and St. Peter Streets, in the City of New Orleans, of a lottery, whereby a person risked the loss of a thing of value in order to realize a profit."
