This is an appeal from a judgment of the Common Pleas Court of Lorain County, rendered for the defendant upon its motion for a directed verdict at the close of the plaintiff's evidence in a workmen's compensation case.

After a denial of the plaintiff's claimed right to an award by the commission, the plaintiff filed the present action in the Common Pleas Court for a determination of the question.
