On November 30, 1955, plaintiff, by his guardian ad litem, commenced an action pursuant to Civil Code, section 231,1 to secure a declaration that defendant is his father. In his verified complaint he alleged that he is 17 years old and that since he was 10 days old he has been in the exclusive care and custody of his grandmother with whom he resides.
