At about 6:30 p. m. on December 21, 1953, Walter J. Glowacki was a passenger in a station wagon being driven by appellant Louis E. Stagoski eastwardly on bypass U.S. Highway 40. Appellant Warren Holste was driving his automobile westwardly and the vehicles collided.
