The plaintiff, Edmund M. Kelley, a seaman, was injured while in the service of the SS W. P. Pollock, operated by the defendant. The cause of action arose out of an altercation aboard the SS W.P. Pollock between the plaintiff and the Second Mate, who allegedly assaulted the plaintiff, inflicting serious injuries.
