In granting defendant's motion to direct a physical examination of plaintiff Julia A. Del Ra who sues for personal injuries, the court at Special Term has imposed as a condition the requirement that a copy of the examining physician's report be sent to the attorney for the plaintiff.

Such a requirement has been sanctioned in the Second Department (Tutone v. New York Cons. R. R. Co.
