Defendant is accused in a two-count Indictment each count of which concerns the same United States Treasury check. Count One charges defendant did wilfully and knowingly forge the endorsement of the payee on the check. The Second Count charges that he wilfully and knowingly uttered and published as true the check bearing the forged endorsement and that this was done with intent to defraud the United States.
