The defendant has been found guilty of promoting and setting up a lottery for money or other property of value in Fairhaven in violation of G.L. (Ter. Ed.) c. 271, § 7, the material part of which reads, "Whoever sets up or promotes a lottery for money or other property of value, or by way of lottery disposes of any property of value, or under the pretext of a sale, gift or delivery of other property or of any right, privilege or thing whatever disposes...
