This was an action brought by appellant to recover damages for personal injuries sustained by him in a railroad crossing accident. The accident occurred in the City of Davenport, Iowa, on U. S. Highway No. 6 on December 22, 1953. The parties will be referred to as plaintiff and defendant respectively.
