Frederick Lee Hoskins, plaintiff in error, hereinafter referred to as defendant, was charged in the court of common pleas of Oklahoma County with the offense of operating a motor vehicle while under the influence of intoxicating liquor, was found guilty of the offense charged, but the jury being unable to agree upon the penalty left that to the court, who fixed the punishment at a fine of $150 and costs taxed...
