Mathew Dale Dallas and Harold Woodrow Stephens were charged jointly in the court of common pleas of Oklahoma County with the crime of aggravated assault. A severance was granted and the defendant Dallas was tried before a jury and found guilty of the included offense of assault and battery, and the jury having failed to fix the punishment, the penalty was assessed by the court at a term of thirty days imprisonment...
