This is an action brought by plaintiff to recover pay and allowances to which he alleges he is entitled as an incident to his service in the organized military forces of the Commonwealth of the Philippines. The defendant has filed a motion for summary judgment, relying upon the pleadings herein and defendant's brief in support of its motion together with exhibits attached thereto.
