This is an appeal from a judgment entered upon a directed verdict for appellee in the district court in appellant's suit for personal injuries brought under the Federal Employers' Liability Act, 45 U. S.C.A. § 51 et seq.

The appellant was injured when he stumbled over a rail and fell while crossing the appellee's tracks in the course of his employment. He contends it was error not to submit to the jury the question of whether appellee failed...
