DUFFY, Circuit Judge.
Relator (hereinafter called petitioner), an inmate of the Illinois State Penitentiary, petitioned the district court for a writ of habeas corpus, charging that he had been convicted of a crime in an Illinois State Court by the use of perjured testimony knowingly used by the prosecution.
