In a trial to the court without a jury the defendant was convicted of the charge of making an unlawful purchase of ten ounces of heroin in violation of Title 26 U.S.C.A. § 2553. Police officers who searched the defendant's traveling bag without a warrant, found therein ten glassine envelopes each of which contained approximately one ounce of heroin.
