The appellant was adjudged guilty under United States Code Title 26, § 145(b)1 of having wilfully and knowingly attempted to defeat and evade a large part of the income tax due and owing by him to the United States of America for the calendar year 1945 by filing and causing to be filed on or about the 15th day of March, 1946, a false and fraudulent income tax return.
