LOVINS, Judge.

This is an action in assumpsit brought by Robert Cook, on an insurance policy issued by Farmers' Mutual Fire Association of West Virginia, a Corporation. The plaintiff and defendant will be hereinafter so designated. A jury trial resulted in a verdict and judgment against the defendant for the sum of $3,800, and a writ of error to such judgment was awarded the defendant upon its application.

The policy was issued on the 20th day of May, 1951...
