On October 15, 1952, appellant, Robert Donald Rowland, was indicted for violating § 12(a) of the Universal Military Training and Service Act,1 50 U.S.C.A. Appendix, § 462(a).2 The indictment alleged:

"[Appellant], a male person within the class made subject to selective service under the Selective Service Act of 1948,
