Defendant was charged by information with committing the following crimes: In counts I and II he was charged with sodomy, in count III with attempted sodomy and in count IV with lewdness. Count II was dismissed from the case during the course of the trial, and the jury returned a verdict of guilty on counts I, III, and IV.
