Plaintiffs brought this action of assumpsit to recover on a policy of automobile insurance issued to them by defendant. The action was commenced by filing a complaint and, after defendant had made answer thereto, plaintiff filed a pleading styled a "demurrer" which the court below and the parties treated as a motion for judgment on the pleadings.
