This is an action against a husband and wife, individually and the marital community, to recover damages for breach of contract. Before the cause was at issue, the wife filed a motion to have herself and the marital community dismissed from the action with prejudice. The trial court entered an order granting this motion. Plaintiff appeals from this order, contending that improper procedure was followed.
