This is an appeal from a judgment of dismissal in a wrongful death case, after a verdict of the jury in favor of the defendants.

Roxbury Homes, Inc., applied to the city of Seattle for permission to make improvements on certain streets by constructing sewers and water mains, together with the necessary appurtenances.
