Early on the morning of October 17, 1950, a fire occurred in an apartment directly above an apartment occupied by Zimmer. Some of the water used to extinguish the fire seeped through the floor into Zimmer's apartment. Later that day Zimmer noticed that the ceiling in his living room had buckled in several places.
