OPINION BY WRIGHT, J., July 14, 1953:

Frank Laniewski, Tom DiSantis, and Francis Mark were indicted on a charge of setting up and conducting a lottery. DiSantis and Mark pleaded guilty and appeared as witnesses for the Commonwealth.
