The within action is to recover rent for premises for the period July 7, 1950, up to and including June 30, 1951, occupied by defendant as a statutory tenant under an expired lease which by its terms fixed the rent at $65 per month. On July 7, 1950, the plaintiff, as landlord brought a proceeding in the Supreme Court under section 4 of chapter 314 of the Laws of 1945 as amended (Business Rent Law)...
