This is an appeal in a criminal case. Appellant was charged under an indictment containing two counts with violation of 18 U.S.C. § 111 which provides:

"§ 111. Assaulting, resisting, or impeding certain officers or employees. Whoever forcibly assaults, resists, opposes, impedes, intimidates, or interferes with any person designated in section 1114 of this title while engaged in or on account of the performance of his official...
